摘要
"无直接利益冲突"作为一种新近出现的冲突形式,对公安管理工作带来了新的挑战,主要表现为:其隐蔽性、突发性使得公安机关难以进行有效的预防;参与者的盲从性、无组织性使得公安机关难以进行有效的处置;参与者行为的偏激性、心态的对立性使得公安机关难以进行有效的控制和化解;参与者的高度异质性使得公安机关难以进行有效的统合。为此,公安机关要革新理念,正确认识包括"无直接利益冲突"在内的各种类型的社会冲突;要建立包括预警机制在内的各项机制;要提高管治能力和水平,规范执法行为,以妥善处置"无直接利益冲突"。
Indirect interest conflicts as a new form of conflicts bring about challenges to police administrative work.They appear to be both latent and abrupt, which make it hard for police agencies to prevent effectively.Because of the blind obedience and anarchy of participants,it is difficult for them to deal with effectively.Because of the extremities and oppositiveness of participants,it is troublesome for them to control and mediate effectively.And because of diversity of participants,it is hard for them to reach agreements.Therefore,police agencies should innovate their minds,get clear insight into all kinds of conflicts including indirect interest conflicts,establish all kinds of emergency systems,improve control and administrative abilities,standardize their law enforcement behaviors and properly dispose of indirect interest conflicts.
