摘要
城市土地国有制是我国现行宪法明确规定的基本土地制度,是我国整个土地制度的关键和症结所在。在建国之后直至现行宪法颁布之前,尽管经历了多次土地国有化的运动,但至少在宪法和法律上都未否认非国有土地的存在。现行宪法中城市土地国有制的规定在制定时就存在着值得商榷之处,并在之后又引发了一系列棘手的问题,尤其在当前的情势下,必须正视并力图解决上述问题。
That all urban land belongs to state is the basic land system which stipulated clearly by China's current Constitution,and also is the key and crux to the whole land system in China.In fact,until after the founding of the PRC and prior to the current constitution,although experiencing a number of land nationalization movements,at least in the Constitution and the law,urban land has been the coexistence of diverse forms of ownership.The provision of the urban land belonging to state in current constitution is open to question,and then caused a series of difficult issues.In particular in the current situation,it is urgent to face up and seek solutions to these problems.
