Democratic Principle and Administrative Procedure

宪法是立法规范行政程序的基础。我国宪法设定的"责任链"模式无法充分保障代议机关对行政行为的约束,因为无论用人手段还是治事手段均存在局限性。在行政程序中遵循公民参与和程序公开原则可以在很大程度上弥补法律对行政权约束的不足,增强代议机关对行政权的控制,更多地满足宪法民主原则的要求。

The Constitution is the base of legalization and standardization of administrative procedure.The ＂chain of responsibility＂ established by the Constitution can not fully protect the restriction of representative institution towards administrative behavior,because there is limitation in choosing a person for a job and in the applicable course.To allow citizens＇ participation and publicize the procedure can remedy legal absence of restriction of administrative power.It is also important to strengthen the control of representative institution towards administrative power and further meet the requirement of the Constitution concerning democratic principle.
