中国环境行政管理在农村非常薄弱,民族自治机关在农村的环境行政管理更是几近缺失,导致民族地区农村环境处于无人监管的境况。民族自治机关在农村环境行政管理失灵的表现:一是民族自治机关环境行政管理体制不完善,难以适应农村环境保护监管的需要;二是民族自治机关环保行政决策机制不科学,缺乏环境与发展兼顾的综合决策机制;三是民族自治机关环保行政执法理念落后,手段单一,效率低下;四是民族自治政府权力介入时的各种扭曲现象,影响了行政执法效果;五是中央政府设立的环境管理制度在民族地区农村很难得到完全的落实;六是对民族地区农民环境权益配置不公,导致引导性环境政策在农村失去市场。
