摘要
文化遗产的法律保护始于近代西方国家,现代以来呈现出法典化、系统化趋势。法国文化遗产法历经两百多年的发展,迄今已形成以《遗产法典》为核心、以物质文化遗产保护为主体的比较完善的法律保护体系,颇具典型性。法国文化遗产法律保护在立法体系、制度设计、理念应用等方面的经验,对于完善和发展中国文化遗产法律保护具有重要的借鉴意义。
Legal protection of the cultural heritage begins in modern western countries and presents codification and systematization trend since modern times.France＇s cultural heritage law has undergone the development of more than two hundred years and has evolved a perfect and typical legal protection system,which centering on CODE DU PATRIMOINE and composed mainly of intangible cultural heritage protection.The article laid special stress on analyzing the principal characters of France＇s cultural heritage law and summarizes its experiences in legislative system,institution design and application of ideas,and it also evaluates the reference value for China combined with current legal protection status of cultural heritage.
