摘要
对法律性别的追问,是沿着20世纪80年代以来西方法社会学研究中出现的女性主义法学及批判法学的路径,探寻法律在面临女性主义对其公正性、客观性等一系列质疑时的可能走向。对法律性别的应然性分析,应当借助后现代思潮这一理论工具,突破二元对立论的窠臼,而后现代女性主义法学在超越现代启蒙运动以来确立的二元对立论的基础上,为法律指出了主体重建之后的可能走向。
Faced these questions of justness and objectivity of law from feminism, we should explore what gender the law is and the possible trend of law by the path of feminism jurisprudence and critical jurisprudence which come into being in the western sociology of law since the 80s of the 20th century. By breaking through the barrier of dualism with postmodernism, we can know what the gender of law ought to be. On the basis of surpassing the dualism established by modern enlightenment, the postmoderu feminist legal theory point out the future of law after the subject is reconstructed.
