摘要
互为逆反的双重金字塔结构、不够均衡的激励与约束机制、过分重视行政级别的人员配置、不甚清晰的内部责任与分工,是造成三审制现实之困的制度性原因。论文力图在坚持三审制本质目标不变的前提下,为三审制的完善提供一些可行性建议。
The article focuses on the dysfunction of Tri-level Methodology of Perusal and Revision resulting from the inter-contrapositional dual-pyramid structure, the unbalanced motivation and restraint system, the overvalued administrative ranking-oriented stuffing system and the indistinct internal responsibilities and labor division. It endeavors to give some feasible advice on the improvement of Tri-level Trial System with the essential goal maintained.
