论美国数据库保护的发展

The Sui Generis Right Protection of United States

长期以来，美国都是运用版权法对数据库进行保护，以Feist案为界大致可分为两个阶段。但作为数据库大国，为了保证其数据库在欧盟国家享有同样的保护，从1996年开始，美国国会在数据库立法保护问题上就进行了不懈的努力和探究，相继在第104届、第105届、第106届、第108届、第110届提交相关议案，希望建立一种类似于欧盟《关于数据库法律保护的指令》、又能在数据库权利人和公众之间取得平衡的数据库保护制度。文章在以上论述的基础上，提出美国数据库保护的两个发展趋势。

Over the years, the United States has been using the Copyright Law to protect databases, and it can be divided into two phases by the case of Feist. But as a big database country, in order to ensure that their databases have the same protection in the EU, the U.S. Congress has made unremitting efforts and explored on database protection since 1996.They submitted the relevant bills in the 104th, 105th, 106th, 108th, 110th congress, hoping to establish a law similar to Directive 96/9/EC on the legal protection of databases to ensure a balance between the public and copyright holders. Based on the discussion, this paper discusses the two trend of sui generis protection.
