摘要
不动产是否适用善意取得有否定说与肯定说之分。鉴于不动产善意取得制度具有的价值功能、理论依据及制度基础,《物权法》第106条确立了该制度。不动产善意取得的法律效果包含物权和债权两方面的法律关系。
There are negation and affirmation about real estate being whether or not applicable to acquisition in good faith.In view of the good faith acquisition of real estate system has the value function,theoretical reason and system basis,article 106 of "the property law" establish this system.The legal effect of the good faith acquisition of real estate contains two legal relationships of the property rights and the creditor's rights.
