摘要
在法制日益健全、人们维权意识不断增强的今天,夫妻一体的观念正在被打破,对于夫妻之间的侵权行为,当事人也应当承担损害赔偿责任。然而,现有民事立法在婚内侵权问题上存在诸多纰漏,无法为当事人提供有效的救济。因而,我国有必要构建婚内侵权损害赔偿制度。本文在对婚内侵权进行法律分析的基础上,结合我国当前婚内侵权立法的不足,对我国婚内侵权损害赔偿制度的构建,提出几点建议,以期对婚姻家庭法的完善有所裨益。
Today the legal system is increasingly getting completed,while people＇s awareness of rights protection is continuing being aroused.The conscious of monogamy is broken.So a litigant should shoulder the duty of damages when tort happens between the couples.However,there are legal loopholes in the civil law legalizations on tort damage.This article deals with the defects on the marital tort legislation,and based on the marital tort legal analysis,trying to give some advises about the construction of the marital tort damage legislation,which can be beneficiary to the marriage and family law＇s approaching perfection.
