The Significance of Perpetrating Act in the Joint Offenders' Classification

共犯人的分类一直存在作用分类法与分工分类法的争执。从罪刑法定原则出发,强调在我国共同犯罪立法中以实行行为为基准确立实行犯概念的必要性,并尝试以实行犯的刑事责任为基准确定其他共犯的处罚,从而建立以单一分工分类法为标准的共犯人分类新体系。

There has been much dispute over whether the action - division classification method or function classification method should serve as categorization standard to classify accomplices. This paper tries to emphasize the necessity to take the committing action as the standard to sort the perpetrator under China＇ s joint offence legislation from the legal principle of punishment, and penalize the other accomplices in the light of criminal liabilities of perpetrator. Thus a new system of joint offenders classification based on action-division classification alone can be set up.
