试论我国目前建设工程法制化存在的若干问题

A Discussion on the Defects of the Construction Legalization in China

结合建筑业的实践,通过对相关法律法规的研究,重点探讨了我国目前建设工程法制化存在的若干问题。这些问题包括:《中华人民共和国建筑法》不够完善;建设工程质量立法位阶偏低;建设工程程序性管理立法不够严肃;建筑业企业信用规制法律化手段薄弱;广大农村民居建设工程质量管理缺乏有效立法;农民工用工资格缺乏法律规制等。通过对上述问题的分析,从立法角度提出了四条完善建设工程法制化的对策建议。

With the practice of construction industry and the study of relevant laws and regulations,the paper discusses the defects in the legalization of construction in China.These problems include the inadequacy of ＂Construction Law of the People＇s Republic of China＂,a lower hierarchy of the construction quality legislation,a loose legislation of construction procedure management,the weak legal means of the credit regulation of construction enterprise,the lack of valid legislation of the construction quality management in vast villages,the absence of legal regulation of employment qualification of migrant workers and so on.According to the analysis of the problems,four suggestions are put forward to promote the legalization of construction from the perspective of legislation.
