特权法律制度是立法者利益权衡的结果,制度背后蕴涵着特定的价值观与立法精神。特权之立法精神不一而足。有的特权制度之设立是为了方便特定职务的履行,有的特权制度之设立目的在于延揽贤士,有的特权制度之设立是出于保护家庭伦理关系,有的特权制度之设立是为了扶助弱者,有的特权制度之设立旨在弘扬道统。

A legal system with privileges is the result of legislators＇ weighing benefits.The system contains particular values and legislative spirit.Legislative spirit related to privileges is varied.Some systems are established with privileges for facilitating the fulfillment of particular duties,some for selecting and recruiting capable and virtuous persons,some for protecting family relationships in accordance with ethics,some for helping the weak and some for advocating the Confucian orthodoxy.
