剖析产品侵权案件的惩罚性赔偿规则——以《侵权责任法》为视角

Analysis of Rules for Punitive Damages in Infringement Cases over Flawed Products:From Perspective of Tort Liability Law

文章认为,恶意销售损害他人健康的缺陷产品的行为必须得到有效的遏制,[2]应当在立法层面加以解决。文章结合《侵权责任法》,剖析了产品侵权案件的惩罚性赔偿规则,在缺陷产品致害案件的实务操作层面,进行了引申分析,指出《侵权责任法》的实施,对于监督企业生产安全、高品质的产品有重要引导意义。

This article holds that effective containment should be placed on those who sell flawed products on purpose to harm people＇s health and that such behaviors should be prevented on the legislative level.Based on The Tort Liability Law,the article makes an analysis of the rules for punitive damages in infringement cases over flawed products and a further analysis of the practical operation of cases that bring about victims for flawed products.The article points out that the implementation of The Tort Liability Law is of great significance for producers to turn out safe and high-quality products under supervision.
