从不同法系的视角分析了西方发达国家的矿产资源所有权制度的历史传统、各自特点以及不同体系,发现西方发达国家的矿产资源所有权制度不仅仅是单一的初始产权制度安排,而是一个内容丰富的体系,不同法系对西方发达国家矿产资源所有权制度安排的约束是通过对地表权和地下权的制度安排来实现的。在此基础上,从地表权和地下权结合或分离的角度,对西方发达矿业国家的矿产资源所有权制度类型进行了划分。

From the perspective ot dltlerent legal systems, tins article anatyzes the historical tradition,respective features, and different setups of the system of the mineral resources of western developed countries. It is discovered that such a system is not only a single initial institutional arrangement, but also a system comprehensive in content. The restraint of the arrangement of the system of the mineral resources of western developed countries used by different legal systems is effeeted by the arrangement of the system of surface fight and subsurface fight. On this basis, from the perspective of combination or separation between surface right and subsurface right, we divide the,tvpes of the system of the ownership of mineral resources of western developed countries.
