Reevaluation of the Present Intellectual Property Protection for Computer Software from the Visual Angle of Interest Balance

通过审视软件的知识产权保护模式,指出权利人个人利益空前强化,而社会公共利益则不断被边缘化,形成的原因在于立法者以经济利益为手段,片面追求刺激软件技术创新,从而无视社会公共利益;同时,软件的技术性特征等因素也加剧了这一不平衡;解决软件知识产权保护中个人利益与社会公共利益的不平衡问题,必须着眼于现有立法框架,从制度和实践两个层面入手。

he paper examines the mode of the protection of the intellectual property of computer software, pointing out that the monopolistic interest of software right holders is highlighted on an unprecedented scale, whereas the social public interest to get access to knowledge and information is constantly marginalized. This results from the fact that with economic interests as the means, the legislators unilaterally pursue for the stimulation of innovating software, thus ignoring the social public interest. Simultaneously, the factors such as the technological characteristics of software, etc. also exacerbate this imbalance. To tackle the problem of imbalance between the individual interest and social public interest in the intellectual property protection, efforts should be made to look at the current legislature framework, starting with two layers-the system and practice.
