摘要
城市房屋行政强制拆迁是当代社会关注的热点问题。由于行政强制拆迁程序法律规范的缺失,实践中严重侵害拆迁相对人合法权益的现象时有发生。拆迁问题中最突出的问题即拆迁补偿问题。对国内外的土地补偿制度和拆迁补偿制度进行述评和比较,分析国内外土地补偿的各种学说,并且进行简要评述,以此为基础对我国的拆迁现状提供一些建议。
Urban housing removal with administrative compulsion is a hot social problem.As the lack of legal regulation of removal procedural with administrative compulsion,there sometimes has such the phenomenon as serious infringement of legal rights and benefits of private party in practice.The most prominent problem is the removal compensation.Some suggestion concerns for present removal problems on the basis of reviewing and comparing the land compensation system and removal compensation system and analyzing various doctrines of land compensation at home and abroad.
