煤层气对外合作项目安全监管有关问题的探讨

Discussion on Supervision on Safety Issues of CBM Cooperation Project with Overseas Partners

本文针对煤层气对外合作项目不同于国内一般合作项目,通过分析合作形式、内容、特点、项目管理机构设置、中外方职责、权力及作业特点,依法提出了中方煤层气公司承担对外合作项目安全生产监管职责,外方作业者实施作业时为安全生产的责任主体,外方作业者的主要负责人为安全生产的主要责任人,外方实施作业时必须接受中方煤层气公司的安全生产监督管理。

Since CBM cooperation project with overseas partners is different from domestic cooperation projects, based on the analysis on the forms, contents and characteristic of cooperation, as well as the organization of project management and the responsibility, rights and working features of domestic and overseas partners, the paper proposes according to relevant regulations that Chinese CBM companies should be responsible for work safety supervision of the project. The overseas operators would serve as the subject of responsibility for work safety during the operation period, and the chief director of the overseas operators should be the responsibility person. The overseas partners should operate under the supervision of Chinese CBM compan, y for safety purpose.
