侵权请求权若干问题思考

Thoughts on Several Problems of Tortious Claims

范围、类型以及基础是侵权请求权的三个核心问题,侵权请求权的范围包括绝对请求权,但不包括相对请求权;我国《侵权责任法》对侵权请求权应当类型化为"防御请求权"、"保全请求权"、"补救请求权;"我国《侵权责任法》对于侵权请求权基础的设定含混不清,有待进一步完善;《物权法》第37条可作为侵权损害赔偿请求权的规范基础,第242条和第244条,属于物权占有场合侵害物权所生的损害赔偿的规定,应属第37条的特别规定。

The scope,type and foundation are the hearts of tortious claims.The scope of tortious claims includes not the claims of relative right,but the claims of absolute right.The tortious claims should be classfied as the preventive claims,the recoverable claims and the compensatory cliams.The article 37 of the Property Law is the foundation of the tortious claims.the article 242 and 244 is the special stipulation of the article 37.
