摘要
现行法律对土地承包经营权的征收及补偿规定并不明确。土地承包经营权作为一个独立的用益物权,在土地征收中应当单独予以征收并补偿。这不仅有理论上与立法上的依据,也是保护耕地与农民利益的需要,同时也符合国际惯例。土地承包经营权征收补偿的标准应当按照土地承包经营权的市场价格,在土地承包经营权流转不充分的地区,该标准可以参照承包期内承包人的预期收益来确定。
Current laws fail to define clearly compensation and expropriation of the contractual right of land.As an independent usufructuary right,the contractual right of land should be expropriated and compensated separately in the land requisition,which is well grounded legitimately and theoretically,is also necessary to protect the farming land and farmers' interests,but is consistent with the international practice as well.The compensation standard for expropriation of contractual right of land should be determined according to the market price of the contracted land.In the area where the transfer of the contractual right of land is inadequate,the compensation standard can be decided according to the expected benefits of the contractor within the period of the contract.
