本文以土地征收制度为研究视角,对"公共利益"与保障私权的关系进行探讨,讨论用界定"公共利益"来保障私权的思路,分析关于"公共利益"的逻辑悖论及"公共利益"与滥用征收权的关系,认为立法应对"公共利益"的范围做出明确界定,最后对"公共利益"之辨进行小结。

The paper discusses about the relationship between the public interest and the protection of private rights;discusses the definition of public interest to protect the privacy;analyzes the logic paradox of the public interest,the relation between the public interest and the abuse of the right to levy;suggests legislation should define the scope of public interest to clearly;gives a feasibility analysis on the collection;and acquisition,and finally gives a summary of the arguing public interest.
