浅议保险代位求偿权

A Study of the Insurance Subrogation

保险代位求偿权作为保险法领域一项重要的法律制度,其要义是为了维护第三人的损害赔偿义务,确定保险人的保险赔偿义务以及防止被保险人的不当得利。传统的保险法理论认为保险代位求偿权是财产保险中的一项重要制度,笔者则认为,保险代位求偿权不应局限于财产保险,其适用的范围应是损害保险。损害保险包括财产保险和人身保险中有损害填补性质的保险。我国保险法对于保险代位求偿权的规定并不完善,实践中出现诸多问题,鉴于此,本文将把握保险代位求偿权的真正内涵,重点阐述现行立法有关保险代位权规定中存在的问题,并提出相关完善措施,以期对完善我国保险代位求偿权制度有所参考。

The system of the insurance subrogation is an essential part of the insurance law,which can clarify the third party＇s duty of indemnity,stipulate the duty of the insurer and prevent the insured from profiting by insurance.It had traditionally been viewed as only a part of the property insurance,while it can actually be applied to the damage insurance which includes both the property insurance and the life insurance pertaining to damage indemnity.So far,the insurance subrogation has not been designed exquisitely enough and there are quite a few problems or puzzles in the actual practice.Thus,this paper aims to discuss the true nature of the insurance subrogation,point out the existing problems,propose some plausible measures for improvement and therefore make some contribution to the perfection of the system.
