Study on Juvenile Probation

少年缓刑在敦促问题少年积极自省、改造及复归社会等方面日益扮演着无以替代的重要作用。通过分析总结出少年缓刑概念、特征、作用及历史沿革;少年缓刑之功能组成及类型;少年缓刑适用对象、条件及依据、少年缓刑专业化等内容。在此基础之上,客观评析目前我国少年缓刑立法及司法实践中存在的问题并提出相应的完善建议。

Juvenile probation plays an irreplaceable role in self-examination,reform,and rehabilitation among delinquent juveniles.This article discusses the following issues： the concepts,characteristics,functions,and historical evolutions of juvenile probation;functional components and types of juvenile probation;and eligibility criteria and relevant legal issues as well as issues on professionalization of juvenile probation.Based on above discussions,this paper objectively analyzes the weaknesses of the current legislative and judicial practices of juvenile probation in China and puts forward corresponding policy recommendations for improvement.
