Re-interpretation of Two Obstacles to Abrogating the Death Penalty in China

国际废除死刑运动不断持续高涨,我国人权理念也不断深入,加之近年来的刑罚轻缓化的刑事政策的兴起,我国必然面临死刑废除的问题。然而死刑的废除在我国还是有一定的难度的,主要来自于民众的阻碍和国家立法机关的不支持。可是在当前的国际局势和刑法现代化的背景下,我们必须寻找途径克服这些障碍,坚决废除死刑。

With the upsurge in the international movement of abrogating the death penalty, the deepening of human fight concept as well as the rise of mitigation of punishment in recent years, we are inevitably confrontedwith the issue of abrogating the death penalty. However, we are also confronted with certain obstacles, which are mainly from people and the legislature. While against the background of the current international situationand the modernization of criminal law, we are supposed to seek for ways to overcome these obstacles so as to firmly abrogate the death penalty.
