论后法优先原则与特别法优先原则在解决条约冲突中的关系 被引量:3

Relations between Lex Posterior and Lex Specialis Concerning Resolving Treaty Conflicts

摘要 解决条约冲突是国际法面临的重要课题,作为解决冲突的两种主要方法,后法优先原则与特别法优先原则在实践中各有其适用范围。但如果后法同时是一般法,先法又同时具有特别法性质,适用上述两种方法就会导致不同的结果。为了解决这一冲突,必须在个案中针对具体情况进行分析,探究缔约国共同的最后意志表述,来决定最终适用于条约冲突解决的具体方法。 The resolving of treaty conflicts constitutes a key issue in international legal construction.As two of the main methods,lex posterior deroga legi priori and lex specialis degrota legi generali,make themselves applicable with their scope respectively.However,it may lead to discrepancy when the lex posterior is at the same time the lex generali,with the lex specialis duplicated with lex priori.In order to determine the applicable rule,a case-by-case analysis must be taken into the consideration,with the aim of exploring the common last will of the contracting parties.
