刑法中期待可能性的内涵和分类是期待可能性理论研究的基础问题,目前国内外学者对该理论的研究颇多,但对期待可能性内涵和分类的专门论述很少。针对这种状况,分析德日刑法规定与实践以及我国学者的相关论述,对期待可能性的内涵予以重新界定,并从不同的角度进行分类。

The connotation and classification of anticipated possibility in criminal jurisprudence is the basic issue of the theory study,while there have been more studies on the theory but less study on the connotation and classification.Therefore,this paper has,from the rules and practices of Germany and Japanese criminal laws and China scholars＇ research achievements,redefined the connotation and then classified them in accordance with different criteria.
