检视我国社会保险争议处理法律制度——基于社会保险法律关系的视角

Viewing the Malpractice of Chinese Legal System for Solving Social Insurance Disputes——from the respective of social insurance relations

目前,我国处理社会保险争议的法律制度比较混乱,导致了对权利主体利益的保护不力。因此,对社会保险法律关系中义务的违背所导致的社会保险争议也独具社会法性质,应采取符合社会法特征的法律制度加以解决,包括:厘清当前相互混淆的劳动争议与社会保险争议,赋予社会保险争议独立地位;扬弃保护平等主体权利义务关系的民事争议处理手段,灌入"社会法"思维,制定社会保险争议处理规则;打破目前不利于保护社会法权利的司法机构设置,创立社会保险(社会事务)法庭。

Recently,our legal systems for solving social insurance disputes are chaotic,leading to the poor protection of rights in social insurance.This thesis clarifies the complicated legal relations in social insurance,comparing of social insurance relations and labour relations,social insurance disputes and labour disputs;constructs the spectrum of social insuranc disputes basing on rights of employees in legal relations;analyzes the unique nature of social insurance disputes;views the malpractice of current legal procedures on solving social insurance disputes.
