A Research into the "Xiangyue" and "Baojiazhang" Mediation to the Civil Dispute in Qing Dynasty

民间调处是清代民事纠纷解决的重要形式,乡约、保甲长调处则是民间调处的重要组成部分。清代乡约、保甲长的职责以及他们在官府与民间之间所扮演的联系作用,使他们成为民事纠纷民间调处的调处者角色。在清代诸多民事纠纷民间调处中都可以见到乡约、保甲长的身影。乡约、保甲长进行的民事纠纷调处对清代民事秩序的维持起着重要作用。

The non-governmental mediation was an important form of the civil case dispute in the Qing Dynasty,and the ＂Xiangyue＂ and ＂Baojiazhang＂ mediation was part of the non-governmental mediation. The responsibilities of ＂Xiangyue＂ and ＂Baojiazhang＂ and the relationship between people and government exactly made them become the mediator to the civil disputes;therefore,we could perceive their function. The mediation by the ＂Xi- angyue＂ and ＂Baojiazhang＂ was of significance to the civil legal order in the Qing Dynasty.
