我国植物新品种保护体制的问题与对策

Problems and countermeasures in protecting new varieties of plants in China

忽视植物新品种保护严重制约了农业科技创新,影响了我国农产品出口。当前,我国科技管理体制不利于品种权的产出,植物新品种保护成本过高,农业科研人员不重视品种权。原因是农民和农业科研人员知识产权意识薄弱,农业科技管理的政府包办体制,农业技术特性造成的维权难度大等。应当改革我国农业科技管理体制,完善植物新品种保护制度,加大品种权保护力度,切实保护品种权人的利益。

In China,the ignoring of variety rights has severely restricted the agricultural technology innovation,and limited the agricultural exports.Now,the agricultural technology management system goes against the output of variety rights;the new plant variety system costs highly;agricultural technicians ignore the variety rights.The reasons were as follows,the farmers and agricultural scientists were lack of intellectual property awareness,the government arranged agricultural technology management,and it＇s difficult to protect the agricultural intellectual property rights for the characteristics of agricultural technology.So,we should innovate the agricultural technology management system,molulate the plant variety system,and severely punish those who violate the variety law.
