全球结社革命的主权理论反思

A Reflection on the Sovereignty Theory in Global Association Revolution

发端自20世纪后半期的"结社革命"见证了公民社会的全球复兴,拓展乃至重构了国家与社会之间的关系与制度空间。然而,现有的结社革命理论并没有能够认真对待公民社会组织与主权国家之间的关系。一方面,从主权的视角来看,结社革命固然是个人权利成长的历史表征,但它同样是一个主权观念不断被重塑的产物;另一方面,对公民社会组织与主权国家之间关系的考察表明,如何处理二者之间的关系,则需要我们进一步从关系性视角反思主权的正当性,重解主权,乃至为公民社会组织的兴起提供合法性依据。

＂Association revolution＂which originated from the post half of twenties century has testified the global revival of civil society,having explored and reconstructed the relationship of the state and society.Otherwise,the theories of association revolution haven＇t taken the relationship between social organizations and the sovereign states seriously.On the one hand,from the point view of sovereignty,we can understand that,although ＂association revolution＂ is the historical evidence of the development of individual rights,it is also the products of sovereignty conception being reconstructed.On the other hand,in review of the relationship between social organizations and the sovereign states,it is necessary for us to reflect on the legitimacy of sovereignty,to reinterpret it and to justify the revival of civil society from the point of relationality.
