刍议法定自诉案件范围的缩小——以第二类自诉案件为视角

Narrowing the Range of Private Prosecution Legal Case:From the View of the Second Kind of Private Prosecution

目前我国有关法定自诉案件的范围过大,在现实中产生了诸多问题,因而需要缩小此类案件范围,将一部分自诉案件转归公诉案件,完善自诉转为公诉的程序规定,增强这一制度的可操作性。

At present,the scope of the statutory private prosecution is too large,which causes a lot of problems in practice,therefore we need to narrowed the scope of such cases,transferring parts of private prosecution case to public prosecution,improving procedural requirements of the private prosecution to public prosecution,and enhancing the system.
