管制刑变革之路径选择——以社会服务刑改良管制刑

THE PATH SELECTION OF PUBLIC SURVEILLANCE REFORM——MODIFYING PUBLIC SURVEILLANCE WITH COMMUNITY SERVICES PENALTY

在世界刑罚发展日趋轻缓化、社会化的今天,学界对管制刑存废这个问题仍旧是各执一词,莫衷一是。管制刑绝对的"存"与"废"都有失其合理性。在特定的历史时期,管制刑曾经起到的积极促进作用是有目共睹的。当然,不容回避的事实是,管制刑作为民主革命时期的产物,其积极意义正在随着时间的流转和时代的变迁而愈益模糊。伴随着行刑社会化的刑罚发展潮流,管制刑亦应理性地融入时代洪流,借鉴社会服务刑,对自身进行大刀阔斧的改革。

Nowadays,the development of penalty in the world becomes increasingly mitigated and socialized,but the academic circle is still uncompromising about the abolition of public surveillance.Neither absolute ＂existence＂ nor ＂abolition＂ of public surveillance is reasonable.In particular historical periods,public surveillance played an active role.However,the unavoidable fact is that as a product of the democratic revolution,the positive sense of public surveillance becomes increasingly blurred as time passes by.With the development of socialized penalty trend,we should reasonably reform public surveillance with community service penalty.
