摘要
公立学校产权是代表国家的各级政府和学校等产权主体围绕对学校的教育投入和学校财产所形成的责权利关系,产权主体关系主要包括政府间、政府与学校、学校内部三个层面。公立学校产权的主要问题是产权界定模糊和对产权主体行为缺乏有效监督机制。以政府为中心的权利分配模式和社会力量的发育不足是形成公立学校产权问题的主要原因,调整政府与学校间的管理关系,积极培育第三方的社会力量是解决公立学校产权问题的基础。
Educational property right of public school is a kind of right-duty-interest relation which the subjects about government and school based on the objects about educational input and school estate. Three are three levels,which are between governments,government and school.Relational is obscure, supervising isn't enough which are primary problem on educational property right of public school. Right Assignment according to governmental need and being weak of citizen society are main causes. We should coordinate relationality about government and school,foster citizen society,which will help to solve problem.
