我国家事案件发展现状及诉讼程序的独立构建

Household Case and Its Litigation in China

家事案件包括我国最高人民法院所称的婚姻家庭案件、继承案件等有关身份关系的争讼案件,和以亲属身份为依据所发生的财产争议案件等。我国家事案件数量的绝对增长和家事案件在民事案件中的比例逐渐下降,是我国家事案件诉讼程序设立的社会现实。家事案件的特殊性、我国民事司法的历史和民事审判方式改革的现状等因素,都说明我国应建立独立的家事案件诉讼程序,家事案件的诉讼程序亦应进行改革,使之符合特殊的诉讼原则和诉讼法理。

Household case includes marriage,divorce,property inheritance and property dispute,etc.,as regulated by the Chinese supreme court.The number of such cases is on the rise,which makes it essential to establish a litigation procedure specially aimed at resolving household legal disputes,and the special nature of household cases and the Chinese civil law conventions all require an independent litigation system.
