关于完善我国BOT立法的思考

Reflection on Improving BOT Legislation in China

BOT是目前国际上流行的投资方式,正日益成为今后我国利用各种资本投资于基础设施建设的重要手段。为了促进BOT投资方式在我国的发展,有必要对BOT投资方式进行专项立法,进一步明确BOT投资方式的主体、政府保证的性质及其内容、BOT项目的审批机构和审批程序、BOT投资基础设施的范围、BOT投资方式正确的解决途径和法律适用等问题。

As an internationally popular way of investment,BOT is becoming an important means for various capitals to invest in infrastructure.To promote development of BOT in China,it is necessary to formulate special laws on BOT to clarify such issues as its subject,the nature and content of government guarantee,approval organ and procedure for BOT project,the range of BOT investment in infrastructure,correct investment methods and applied laws.
