中美土壤污染防治立法比较及对我国的启示

Comparison and Inspiration of Legislation on the Soil Pollution and Control in China and USA

中美两国都是将有关土壤保护的内容分散在多部法律中,但美国通过制定法律修正案填补了专门性立法的空白,对"棕色地块"进行了有效治理。由于我国土壤污染防治立法存在大量空白,故在立法模式上不宜采取法律修正案的方式,应该进行土壤污染防治专门性立法。在立法技术和立法内容上,美国土壤污染防治立法明确的立法目的、详细的法律内容、完善的法律责任制度都给予我们诸多启示和借鉴。

The provisions of soil protection are dispersed in many laws in both China and USA,however,the USA fills the blanks of legislation by a special legislative amendments and remedies brown fields effectively. Because there is much blank of legislation on soil pollution and control, China can't take the pattern of legal amendments, it shall make special legislation on soil pollution and control it. In the technology and content of legislation, the clear legislative intent, detailed content and sophisticated responsibility system of legislation on soil pollution and control in USA provides us so much experience and inspiration.
