论间接正犯中的认识错误

间接正犯是共同犯罪中的一个重要问题。间接正犯错误,主要是事实错误问题。本文以中国大陆的刑事立法与司法为视角,对间接正犯进行了研究,认为利用者对被利用者行为性质认识上的偏差,均不会影响间接正犯的成立。

The conception of indirect accomplice is an important issue in the theory of joint offence.The mistake issue of Indirect principal refers to the fact mistake mainly.In this essay,the author discusses this issue from the perspective of criminal legislation and enforcement in China's Mainland,and belive that the user＇s cognitive deviation would not affect the conviction of indirect accomplice.
