《物业管理条例》实施以来,一些条文在司法实践中遇到不少问题,有些问题争议较大。这些问题主要包括业主委员会催缴物业费是否构成起诉前提的争议、举证责任争议、业委会主体地位的争议、管辖权争议等。针对这些争议提出了修改完善《物业管理条例》的建议。

Since the implementation of the ＂ Property Management Regulation＂ , some clauses in the judicial practice encounter some problems, some of which are quite hot. These problems mainly include whether the owner committee＇s hastening property fee constitutes a precondition of a charge, burden of proof, etc. This article discusses these problems and puts forward sonic advices for the modification and improvement of ＂Property Management Regulation＂.
