政府信息公开诉讼制度运作规则研究——以我国《政府信息公开条例》为视角

Foreign Government Information Comparative Study of Operating Rules of Litigation

政府信息公开诉讼作为一种新型的行政诉讼,是前沿问题之一,有关政府信息公开诉讼的理论论述并不多。本文根据所学行政诉讼法学基本理论,尝试结合当前政府信息公开诉讼所面临的现实问题,探讨先进国家政府信息公开制度并与我国信息公开制度的立法进行比较,全面地对政府信息公开诉讼之运作规则进行研究,以期引起一些争鸣,达到进一步推动我国信息公开制度建设的目的。

Government Information Disclosure litigation as a new type of administrative proceedings,is the forefront of one of the issues,and there are many government information theories of open litigation.Based on Administrative Litigation Law learned basic theory,this paper manages to combine the current government information public proceedings of the practical problems faced by exploring advanced countries in the open system of government information disclosure system on China＇s Legislation and comprehensive government information on the operation of public litigation rules study with a view to the subject of some con-tention,the purpose of which is to further promote China＇s information disclosure system construction purposes.
