图书馆视角中的著作权许可模式研究

Research on the Copyright Licensing Model from the Perspective of the Library

图书馆是体现社会知识公平与自由获取的知识传播机构,是体现著作权法律平衡精神的利益平衡器。著作权法在促进知识的创造与传播的同时,也制约与影响着图书馆传播与利用知识的行为方式。著作权的许可使用是著作权行使的主要方式之一。正确利用著作权的许可授权,获得更广泛、更自由的传播与利用知识的权利,是影响图书馆发展的焦点问题。本文从图书馆视角分析我国现有的著作权授权许可模式,对其在图书馆的适用进行研究。

The library is a knowledge dissemination agency embodying the fair and free access to social knowledge,and is also an interest balancer embodying the balance spirit of the copyright law.While promoting the creation and dissemination of knowledge,the copyright law also restricts and influences the behavioral model of the library in disseminating and utilizing knowledge.The licensed use of the copyright is one of the major types to exercise the copyright law.The correct use of the copyright license granted to obtain the right of a wider and freer dissemination and utilization of knowledge is the focus of attention affecting the development of the library.From the perspective of the library,this paper analyzes the present granted mode of copyright license in China,and studies its applicability in the library.
