The right to new varieties of plants as a new type of intellectual property right is growingly concerned by the international community.With the development of biotechnology,developed countries continue to strengthen the protection of intellectual property right, while taking advantage of its advanced biotechnology to restrict use of new varieties in developing countries.In this case,the right to new varieties of plants must be balanced with the interests of farmers.Therefore,the paper summarized and analyzed the interests of farmers in the protection of new varieties of plants,and presented perfect proposal to the system.
