试论韩日司法能动性及其对我国的启示

Judicial Initiative in Korea and Japan v.s China's Attitude toward Judicial System

同样的司法制度因实施者的态度不同,分为司法能动主义与司法克制主义。同处东亚的韩国走向了司法能动主义,而日本却走向了司法克制主义。比较研究韩日两国的司法态度,可以看出我国应从司法克制主义走向司法能动主义。

As different executors have different attitudes,a same judicial system can be divided into judicial activism and judicial restraint.Though both Korea and Japan are situated in East Asia,the former prefers judicial activism while the latter adopts judicial restraint.With the comparison of the attitudes of the two countries,it can be concluded that China should change its attitude from judicial restraint to judicial activism.
