对患者知情同意权问题的探讨

A Discussion on How to Respect the Patients' Right of Informed Consent

在医疗实践中尊重患者知情同意权,是医务人员的义务。目前我国立法、司法和医疗实践中存在着依理性医生标准和按家长式医患模式行事的倾向,其结果为患者的知情同意权得不到充分尊重。文章从医患双方的共同参与、知情同意书的改进、风险的告知、患方对告知内容的正确理解、对患者弃权行为的尊重五个方面,提出了如何改进医务人员告知行为方式的建议,以期对解决和克服目前在医疗工作中存在的此类问题有所帮助。

This article discusses the legal origin of the patients＇ right of informed consent,pointing out the drawbacks which are derived from the implementation of rationality-based doctor＇s standard and paternalistic approach in the legislation and legal and medical practices in China,somewhat lead to disrespect of patients＇ right of informed consent.To improve the situation,the writers make a number of suggestions to make the inform of information more acceptable to the patients in terms of cooperation between clinicians and patients,improvement of the document of informed consent,risks inform,and understanding of the patients on the disclosed information and respect of the patients＇ right waiver.
