摘要
如何确定适格被告是律师实务中经常遇到的问题,非常重要,却又为我国法学理论界所忽视。通过一起商业特许经营纠纷的案例,阐述了选择被告应当考虑的几方面因素。
How to determine the appropriate defendants is a problem lawyers often encounter in practice,which is very important,but always ignored by China＇s legal circle.This paper starts with a case about the business franchise disputes and describes nine factors that should be taken into account when selecting the defendants.
