民族传统器乐艺术上既要保护其传承性也要保护其创新性。传承性应归置到"非物质文化遗产法"框架下保护,而创新性应归置到《著作权法》和《专利法》框架下保护,在此基础上构建出对民族传统器乐艺术法律保护的体系。

Art of traditional ethnic instrumental music is to protect its heredity and innovation.The heredity should be placed on the ＂non-matter cultural heritage law＂ and the innovation should be placed on the ＂copyright law＂ and the ＂patent law＂.Basing on this,we can construct a legal protection system of Art of traditional ethnic instrumental music.
