摘要
关于无船承运人能否享受海事赔偿责任限制的权利,法律未作明确规定,而理论和实践中对此存在着很大的争议。无船承运人在运输贸易中要面临着巨大的海上风险,而其赔偿责任承担能力却相对较弱,为公平地保障无船承运人的利益、促进海运业和无船承运业的长远发展,赋予无船承运人以海事赔偿责任限制的主体资格,具有很大的必要性。而救助人、责任保险人等责任限制主体的纳入也为无船承运人享受海事赔偿责任限制突破了理论上的障碍。因此,赋予无船承运人海事赔偿责任限制权是完全可行且应当的。
There is a hot debate about whether Non-vessel Operating Common Carrier(NVOCC) has the rights of limitation of liability for maritime claims in the theory and practice because the law does not make clear stipulation.NVOCC also must face enormous risks at sea,and its ability to assume liability is weak.For the sake of protecting the interests of NVOCC and promoting the maritime industry and non-vessel industry,it is necessary to allow NVOCC to have the rights of limitation of liability for maritime claims.
