传统民法以人为中心,而人又是一个多样性的存在,因此,围绕在人的何种性质上确立人的人格问题,以康德哲学中的二元论为方法,对自然人的人格要素做出双重区分,主张只有在超越经验的人的积极的本质要素———理性和意志自由能力中,才能为自然人成为平等的民事主体寻找到伦理根据;也只有对自然人人格要素坚持二元区分,作为人的经验具体的"不自由的自然"的身体诸要素,依其性质才能成为权利的客体,人格权制度才能成立。

The traditional civil law takes the human as a center,but the human is also a multiple existence.Therefore,centreing on establishing person＇s personality,this article takes the Conde philosophy＇s dualism as a method,makes dual discriminations about natural person＇s personality essential factor,advocates only can we seek the ethics basis for natural person becoming the equal subject in rationality and will freedom ability.Also only when we insist the dual discrimination,can we take the person＇s body as the object of rights,and then the personnnal right system can establish.
