Analyzing Several Issues on "Hate Crime"

"仇恨犯罪"并非新生事物,它纵可溯至我国古代的"复仇文化",横则涉及英美法系国家的"HateCrime",只是它一直未能引起我国刑法学、犯罪学理论与实务界的应有关注。当前,我国正处在社会大变革的转型期,在构建和谐社会的进程中面临着多方面的挑战,仇恨犯罪即为典型表征之一。提出"仇恨犯罪"的概念,从而认真对待这种犯罪现象,对仇恨犯罪进行数据收集与统计,对其产生的原因、特点以及刑事法内外的抗制措施进行分析研究,具有十分重要的现实意义。

＂Hate Crime＂ is not a novelty. It may be traced back to the ancient ＂revenge culture＂ , and it relates to ＂Hate Crime＂ in Anglo-American law countries. However, it has failed to arouse the attention it deserves in China. Nowadays, China is facing with great social changes and many challenges, among which hate crime is one of the typical characterization. It is of great practical significance to produce the concept of ＂Hate Crime＂, to take this phenomena of crime seriously, to do statistic analysis of the data, to study on the causes, features, prevention and punishment measures.
