摘要
网络交易作为一种新兴的交易方式,与传统交易方式相比,具有交易主体虚拟化、交易标的无形化、数字化和信息化、交易支付手段的电子化和高度信用化等特点。网络交易的兴起增加了网络交易中消费者的知情权、交易安全权和求偿权保护上的难度,而我国现行相关立法对此规定不足。因此,有必要通过提高立法层级、明确消费者知情权保护原则、增设消费者后悔权和建立在线纠纷解决机制等途径完善我国网络交易中消费者权益保护立法。
Compared with the traditional trade, online transaction is a new rising trade way with virtual subjects, intangible and digital object, electronic and a high degree of credit means of payment transactions. The rise of online transaction makes it more difficulty to protect consumers" right of information, security transaction and claims for compensation. While it lack relative provisions in current legal system. Therefore, it is necessary to improve legislative level, define the protecting principles of consumer's right to know, add consumer's right to regret and establish online dispute resolution mechanisms to improve consumer'ri^hts protection legislation in online transaction.
