摘要
非标准劳动关系是区别于标准劳动关系的劳动关系类型,它突破了标准劳动关系的固定特征和框架,是现代劳动关系发展的重要趋势。现有的《劳动合同法》未能对非标准劳动关系进行全面、有效的规范。对非标准劳动关系进行立法规范必须坚持适用劳动基准法的一般原则,坚持一般规范和特殊规范相结合的规范模式,坚持开放性、积极性、低标准、广覆盖的规范思路和原则。
Non-standard employment relationship,which is distinguished from standard employment relationship,breaks through the fixed features and framework of standard employment relationship and has been an important trend of modern labour relationship development.The current Labour Contract Law has neglected the legislation regulation of non-standard employment relationship.To establish an effective legislation regulation system toward non-standard employment relationship,we should adhere to common principles of labour standdards law,the regulation pattern with a combination of general regulation and special regulation,and the regulation principal advocating openness,activism,low standard and wide coverage.
